Do you need a solicitor for a prenup?
Independent legal representation is required for a prenup to be deemed valid in a court of law. If both parties had independent legal advice when creating the agreement, and it is deemed fair, then a court of law is more likely to adhere to it when deciding on the distribution of assets in a divorce.
Is postnup as good as prenup?
As long as you seek independent legal advice in creating a postnup and it is accurate and fair, it has just as much chance of being used in a court of law to form the basis of a divorce settlement as a prenup.
What is the alternative to a prenuptial agreement?
Other methods to protect your assets incase of divorce include loans and trusts.
To protect family wealth, many people will draw up formal loan agreements before giving large sums of money to their family members to protect that money if the recipient goes through a divorce. Money given as a loan is better protected because it is assumed the money needs to be paid back, not divided between the divorcing parties. It will therefore often be left out of divorce settlements.
Trusts are also used to protect family wealth or financial gifts. A trust which was created correctly by a qualified legal professional can ensure assets remain with their intended beneficiaries even in the case of a divorce.
