Independent legal representation is required for a prenup to be deemed valid in a court of law. Though prenuptial agreements are not technically legally enforceable, having a qualified family law solicitor create your prenuptial agreement ensures it is accurate, best represents your interests and gives you the best chance of being able to use it as a legal framework during divorce proceedings if necessary.

Prenuptial agreements are not legally enforceable documents, but can form the basis of a divorce if deemed valid by a court of law. If the prenup is seen as fair, and was created with a qualified family law solicitor, it is much more likely to be adhered to in a court.

Similarly to prenuptial agreements, postnups are not legally enforceable documents, but are increasingly being used as the basis for divorce proceedings in the UK. If both parties had independent legal advice when creating the agreement, and it is deemed fair, then a court of law is more likely to adhere to it when deciding on the distribution of assets in a divorce.

As long as you seek independent legal advice in creating a postnup and it is accurate and fair, it has just as much chance of being used in a court of law to form the basis of a divorce settlement as a prenup.

Other methods to protect your assets incase of divorce include loans and trusts. 

To protect family wealth, many people will draw up formal loan agreements before giving large sums of money to their family members to protect that money if the recipient goes through a divorce. Money given as a loan is better protected because  it is assumed the money needs to be paid back, not divided between the divorcing parties. It will therefore often be left out of divorce settlements.

Trusts are also used to protect family wealth or financial gifts. A trust which was created correctly by a qualified legal professional can ensure assets remain with their intended beneficiaries even in the case of a divorce.
