Can you divorce without a solicitor?
Yes, it is possible to finalise a divorce without a solicitor, however, it is not recommended by legal professionals. This is because there can be unforeseen complications when it comes to deciding how assets and finances are split, or how childcare will work into the future.
Can a divorcing couple use the same solicitor?
Yes, a divorcing couple can use the same solicitor, this is generally known as the “one couple one lawyer” approach. It can help reduce the overall cost and move the process along more swiftly, however, it’s only recommended when the couple are in agreement on the settlement and there are no issues to solve that could give rise to conflicts of interest.
How long does a divorce take?
Typically, a divorce in the UK takes around six months to complete. This is due to the necessary waiting times that are implemented as part of the process. This can, however, be stretched over many more months depending on the complexity of the divorce and the amiability of both parties.
How long can a spouse drag out a divorce?
There is no set time frame in which a divorce needs to be completed by, therefore a complicated divorce can, in theory, take years to complete if parties cannot agree on the settlements. If you feel that your spouse is deliberately delaying the divorce proceedings, you should seek legal advice on the matter, as the court may be able to put an order in place to remedy the delay.
How does divorce affect inheritance tax?
Transfers between spouses are free from inheritance tax (IHT), even during separation, until the divorce is finalised. After the divorce is official, transfers may still avoid being taxed if they are between the ex-spouses and weren’t meant as gifts or were made to support the family. Similarly, transfers made because of a court order, such as setting up trusts, are usually not considered taxable gifts.
