- It’s fair
- It was written by a solicitor
- Both parties agreed
- There has been no changes in the financial situation for the former couple
Can you cancel a separation agreement?
Separation agreements can be voided in the following circumstances:
- Both parties agree to it, in other words, there is ‘mutual agreement’.
- One party can apply to the court to challenge a separation agreement via a court order.
- In some situations it is up to the court’s discretion to overturn a Separation Order on the grounds that it is unfair or significant changes have occurred since its creation.
