A formal separation agreement can alleviate the tension from a relationship breakdown, providing both parties with a clear understanding of their position. It offers mutual clarity and assurance. Even though they’re not legally enforceable, the court will support – if contested – agreements that have been appropriately and justly negotiated.

Unmarried couples frequently encounter similar problems to married couples when their partnership concludes, but the legal circumstances are very different. Separation agreements can also be beneficial for unmarried partners as a means to address the division of shared assets and obligations.

A separation agreement can be changed with the consent of both parties.

A separation agreement is not legally binding in the UK when ending a civil partnership or marriage. However, it can be used as the basis of a financial settlement or custody order if the couple do eventually choose to proceed with a divorce. A judge may recognise it as a formal agreement if: 

  • It’s fair
  • It was written by a solicitor
  • Both parties agreed
  • There has been no changes in the financial situation for the former couple 

Separation agreements can be voided in the following circumstances: 

  • Both parties agree to it, in other words, there is ‘mutual agreement’.
  • One party can apply to the court to challenge a separation agreement via a court order. 
  • In some situations it is up to the court’s discretion to overturn a Separation Order on the grounds that it is unfair or significant changes have occurred since its creation.
